PO2SO Terms of Service

Welcome, and thank you for your interest in PO2SO, including our website, cloud platform, APIs, integrations, applications, and all related software, features, and services (collectively, the "Service").
These Terms of Service ("Terms") form a legally binding agreement between you ("Customer", "you", or "your") and PO2SO ("PO2SO", "we", "us", or "our") governing your access to and use of the Service.
If you access or use the Service on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. By creating an account, accessing, or using the Service, you agree to these Terms.
Licence and Access to the Service
Grant of Licence
Subject to your compliance with these Terms, PO2SO grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Service during your active subscription period. All intellectual property rights in the Service remain the exclusive property of PO2SO.
Free Plan and Paid Plans
PO2SO may provide the Service under both a Free Plan and one or more Paid Plans.
- Free Plan: Intended for evaluation or limited use. May include feature limitations and usage caps. PO2SO may modify or discontinue it at any time.
- Paid Plans: Provide additional functionality and support as described on the pricing page or order form. Access begins once payment is processed.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must notify PO2SO of any unauthorised access.
Restrictions on Use
You must not copy, resell, reverse engineer, decompile, or attempt to extract source code from the Service. You may not use the Service to build a competing product or circumvent safeguards.
Feedback
If you provide feedback, you grant PO2SO a perpetual, irrevocable, worldwide, royalty-free right to use and commercialise such feedback without restriction.
General Payment Terms
Subscription Billing
Paid Plans are billed monthly or annually. By subscribing, you authorise PO2SO to automatically charge subscription fees at the start of each billing cycle.
GST
Fees are inclusive of GST for Australian customers unless stated otherwise. Customers outside Australia are responsible for applicable taxes in their jurisdiction.
Refund Policy
PO2SO offers a 30-day money-back guarantee for first-time subscriptions. Refund requests must be submitted in writing within 30 days. This does not apply to renewals, custom development, or third-party costs.
Cancellation
You may cancel at any time. Cancellation takes effect at the end of the billing period. Fees are non-refundable except where required by law.
Data, Privacy and Security
Customer Data
You retain ownership of all data uploaded to the Service ("Customer Data"). You grant PO2SO a limited licence to process Customer Data solely to provide the Service.
Data Security
PO2SO implements reasonable technical and organisational measures to protect data. However, no system is completely secure.
Privacy
PO2SO handles personal information in accordance with its Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth).
Service Availability and Changes
The Service is provided on an "as available" basis and may be subject to interruptions for maintenance or upgrades.
Limitation of Liability
To the maximum extent permitted by law, PO2SO’s liability is limited to the amount paid by you in the 12 months preceding the claim. PO2SO will not be liable for indirect or consequential damages.
Termination
PO2SO may suspend or terminate access if you breach these Terms or fail to pay fees. Upon termination, access to the Service ends immediately.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of NSW courts.
